Adjustment of Status as a DV lottery Winner? is it possible as an illegal alien?

My financee won the DV lottery. He entered the country legally as a visitor 7 years ago as a visitor but has since over stayed. Can he adjust his status and pay the $1,000 fee or will he have to go back to his country of origin to apply. Please help

Your fiance should not leave the country without first consulting an immigration attorney. He can not make use of the lottery, but should the two of you marry (assuming you are a US citizen) he may then obtain status.
