Applying for Citizenship

I have been a permanent resident since 1998. In Oct 1998 and January 1999. I had a domestic situation with my ex-spouse. I was arrested and found guilty. Since then I went back to court in 2006 to have all charges dismissed and vacated. The judge vacated and dismissed all charges. I�m now in the process of filing for my N400 application and have concerns with Part 10. Good Moral Character Questions 17, 18. I assume that I�m supposed to answer YES regardless of the convictions being dismissed or vacated along with a written explanation. My biggest concern is how this will affect my chances of being a U.S. Citizen�Please could you advise me. Thank you!

This is a very good question. You are required to truthfully answer all questions. However, the CIS might take the position that you lack the requisite good moral character. But, if that is the case, you can appeal that decision and if you lose the appeal, you can always fight that appeal in a federal court.
