Legal Question in Immigration Law in Georgia
I am a Canadian citizen living in the US on an H1-B visa. I am married to a US citizen and have a 6-month old child. My wife has just filed for a divorce and does not want to sponsor me for an H1-B visa.
When my H1-B expires next October (October 2012) will I have any legal custody rights to my child?

You can pursue custody and visitation regardless of what happens in the immigration case. The two are unrelated.
You should obviously have already hired two separate lawyers at this point - one who specializes in divorce and one who handles immigration. Make sure the two work together and follow their advice. They are vital in this situation.
