Legal Question in Immigration Law in Georgia
what should i say on this
hi
i was once cited for a mandatory court appearance, for a reckless driving in VA (20mph over speed limit),which is a criminal violation in VA..
i appeared at the court and the case was reduce to speeding, with a fine...
and i got a speeding ticket then...
now,in the DS 156,question 38, do i need to say YES or NO, where it asks have i ever been arrested, convicted, for crimianl case..
in my case,i was just cited, not even arrested..
so should i say YES or NO...please suggest
will this cause any issue during my h1b stamping
i have all my court papers, that says, the case has been reduced to normal speeding

You should answer no but just in case have a certified copy of the charging documents and a certified copy of the dispoistion of the court if this question comes up during the interview.

If you were never arrested nor convicted of the reckless driving charge, and it was subsequently reduced to speeding(a traffic infraction, you should check the NO box.
