If you entered the country with inspection (with a visa), you are eligible to adjust status to lawful permanent resident based on your marriage to a U.S. Citizen. If you did not enter with inspection, you will need to process your application through a U.S. Consulate abroad with a waiver. The waiver must demonstrate that your U.S. Citizen/Lawful permanent resident spouse or parent would suffer extreme hardship if you were not able to return to the United States.
