Legal Question in Immigration Law in Georgia

Divorce before permanent residency

My wife and I have been married for 1.5 years and have 1 child together (1 year old). She has 2 children from her previous marriage. She punched me on my face when she was pregnant (and when we were engaged) and gave me a nose bleed and busted my mouth in front of her children. I called 911 but the police said that I had to file charges, which I did not. She again threw me her cell phone at me and threw my things out of the house (after we got married) so I call 911 again. However, the police told me that I had to leave the house since it is under her name. We had two houses (mine and hers) when we got married and were living in mine. When I got laid off, we stayed there until it was sold. Ever since we moved to her house, she's been telling me to get out of her house when we get into an argument. I once had to sleep in my car. She also knows immigration situation so she is abusing the situation. I would like to file for a divorce but want the custody of my child and be able to stay in the country.

Has any paperwork been filed on your behalf with the immigration service based upon your marriage? There are options available under US immigration laws to protect noncitizens from abusive spouses. You will need to contact an attorney. If you would like to discuss your situation further, you may contact my office by telephone or email.
