If he overstayed more than 180 days at the age of 18 or older, he faces a bar to re-entry once he leaves the country. He should definitely have an experienced immigration attorney review the details of this case before he does anything! You should contact your local Bar Association for referrals.

With respect to prior counsel he may not have accrued unlawful presence depending on what status he used at entry. As well depending on when he entered and when the visa petition was filed he may still be able to adjust. Please feel free to contact me to discuss retaining our firm to represent you and your family in your immediate and future immigration needs.
