what is the statute of limitations if some enters with legal passport, perhaps has a improper visa stamp

I don't believe there is any statute of limitations on entering with an "improper" visa stamp. The question is missing details; for example, why are you asking this question? Second, when you say improper what exactly do you mean -- do you mean fraudulently, by error, or what? Third, does the person intend to remain in the U.S. or leave?
