Legal Question in Immigration Law in Georgia
husband here illegally
Hi, I am a U.S citizen. I am filing for my husband of two years, but he came to this country in the trunk of a car. What are the chances that he has to return to his country, and his chances of his I-130 form being approved or denied. (he is a sweet guy)

If your husband enter without inspection, he has to go back to his home country for interview. He is not eligible to adjust his status in the United States.

You can file the I-130 but he'll likely need to return to his home country to process for the green card interview in conjunction with a waiver.
