You need to hire an immigration attorney immediately or risk being deported - and I mean NOW. Call your local bar association for a referral if you do not know of anyone - it is likely you will have to see someone in Atlanta. GET AN ATTORNEY NOW! No one can help you here or guess as to what an immigration court might do - it is a crap shoot - with your entire life as the prize. Anyone disagree?
Since you and your husband were lawfully admitted into the United States and have never departed, then you may not be subject to the 10 Year Bar. This Bar is triggered when you depart the country. Otherwise, assuming that your daughter is a United States Citizen now, she may be able to petition for you and your husband as Immediate Relatives and have the overstay forgiven.
But, in order to travel and avoid the bars I mentioned above, you and your husband will need to obtain the Green Card before you can do that.
There are many complex issues involved in this process and I recommend that you hire an attorney to assist you. Since Immigration Law is a federal law practice, I can assist you from my state of practice. For more information, please contact me.
