Illegal Immigrant Fiance

My fiance came here on a visa before he met me. It has since expired but we are looking to get married. What needs to be done so he can become a legal U.S. Citizen so we can get married..?

He's not illegal, he's an overstay. Pursuant to the Immigration and nationality Act and subject to a determination by an immigration officer, your marriage and subsequent filing for adjustment of status would cure the overstay and he can receive a green card.

If you are a U.S. citizen, you should marry as soon as possible. You will then file a petition for your spouse and, simultaneously, he will file his application for residency and work authorization. Only after he is granted his lawful residency, will he be able to file for citizenship. I suggest you do this promptly as he may be barred for several years if he is picked up and has to leave the country.
