Re: Legal status
If an alien has been granted permanent residency, a green card, without conditions, that is, for a ten-year period, you get to keep your green card if his or her spouse dies or divorces the alien. Now, the exception to this rule is: if an alien has obtained a green card by fraud, or misrepresentation, that could cause problems in the future if the alien applies to renew his or her green card, or applies for another benefit such as citizenship. Also, if the alien commits a crime that renders him or her deportable, that could also cause problems with retaining a green card and remaining in the U.S. So, if all is good, and the marriage to this U.S. citizen was bona fide, then the spouse may remain in the U.S. as a lawful permanent resident. Good luck!
