Hi,
An immigrant petition is filed with the USCIS, and it will take several months for approval, by which time the priority date may be current in the F2A category: www.h1b1.com/sponsor.htm
There are other factors involved such as the current location of the immigrant spouse (whether in the U.S. or outside the U.S.), whether there is violation of immigration status if in the U.S., whether the sponsoring spouse is eligible for naturalization at this time, etc.
Please call our law firm at 212-268-3580 during business hours to discuss, or email [email protected] for guidance.
