Legal Question in Immigration Law in Georgia

Marrying an American Citizen

I met my fiance in 2002, I am Canadian and he is American, he asked me to move in with him and we have been together ever since. A child was born to us in 2003, in the State of Georgia. We are now planning a wedding, may I legally marry him or are there laws that will prevent this? I am 38 and he is 44, we are both legally divorced.

Yes, you can marry him. If he is a U.S. citizen, then you may want to consider adjusting your status, because it appears that you do not have a status in the U.S.

You can marry him and he can petition for you as a spouse so that you can adjust your status and become a conditional resident and then a permanent resident. After marriage, you are considered an immediate relative in terms of immigration benefits.

You can call me at 214-526-6688 in Dallas to set up a detailed consultation or email me.

Re: Marrying an American Citizen

Congratulations! You may marry him. However, it is important to know that after marriage you will be entitled to obtain a green card, but it will not be automatic. There will be some paperwork to be done! There are also a few other matters that you will want to review with an immigration attorney. If you would like my assistance, please call or email. Please note that I do not charge for initial consulations.

Best wishes to you both!
