Marrying an American Citizen

I met my fiance in 2002, I am Canadian and he is American, he asked me to move in with him and we have been together ever since. A child was born to us in 2003, in the State of Georgia. We are now planning a wedding, may I legally marry him or are there laws that will prevent this? I am 38 and he is 44, we are both legally divorced.

Yes, you can marry him. If he is a U.S. citizen, then you may want to consider adjusting your status, because it appears that you do not have a status in the U.S.

You can marry him and he can petition for you as a spouse so that you can adjust your status and become a conditional resident and then a permanent resident. After marriage, you are considered an immediate relative in terms of immigration benefits.

Congratulations! You may marry him. However, it is important to know that after marriage you will be entitled to obtain a green card, but it will not be automatic.
