Legal Question in Immigration Law in Georgia
Visa renewal and a criminal record
long story short. Boyfriend is a permanant resident until 2014. he is a citizen of the Dom. Rep. he went to jail for 2 years for a drug related crime in 2002.
Ive heard various answers , but is there any way shape or form that he can renew his visa when its time? marriage to a US citizen? clearly we would need to hire an attorney, I just need to have some sort of answer on if anything is even possible to help his situation. He's been a permanent resident since 92 or 93 i believe.
I appreciate your help and this site.

Re: Visa renewal and a criminal record
An individual with a conviction for a controlled substance violation is inadmissable and will be denied adjustment of status or an immigrant visa. If the conviction is for a single offense of personal possession of 30 grams or less of marijuana, he or she may apply for a waiver. However, beyond simple possession of marijuana, there is absolutely no waiver for persons who would like to become LPRs but have a controlled substance violation. Source: "Immigration Consequences of Criminal Activity" by Mary E. Kramer In essence, he will face grave difficulty in renewing his LPR status and adjustment of status is out of the question.
