Legal Question in Immigration Law in Georgia

Working for a previous employer with H-1 visa

I was employed by a software company in 1998, let's call it 123. I had an H-1 visa for that company which is valid till 2001. I left that company in that year. I then joined another company, let's say abc. This abc company is not sponsoring my green card. Can I now go back to that same previous company 123 and work for them assuming they will sponsor my green card.

I would suggest you contact the American Immigration Lawyers' Association in Washington, D.C. to find an Immigration lawyer in your area.

When you left the first employer you were obligated to file and obtain a new H-1 for the new employer. If you didn't you might have some problems.

If abc filed an H1B for you then you have been working for abc legally. But if abc filed nothing you have violated your status by acepting unauthorized emoployment. That could cause all kinds of problems. But if you haven't acccepted unauthorized employment you can return to 123.
