Auto Accident
I was involved in a auto accident May 22,2002. I was pregnant at the time of the accident. I was rear ended into the car in front of me resulting in major damage to my C220 Mercedes. The car I hit was a local judge & did not want an accident rpt. because he knew it was the driver behind me that was at fault. The officer dismissed him and sited the guy who hit me with fault in causing the entire accident. I did go to the hospital to make sure the baby was o.k.
My insurance company took over the claim because of delay from the others insurance co. The total repairs have reached $8,321.83 & the rental car total bill was $1,266.00.
Since my ins. co. took over I had to pay my deductible of $500.00 plus any amt. over $500.00 on the rental car.
The person at fault is now contesting the police report stating he is not at fault!!! His ins. co. is refusing to pay until a complete investigation can be done!!! So I cannot get my money back.
I have been suffering from lower left side pains since the accident, and last week my OB/GYN discovered I have a small herneia (He thinks it is the result of the seatbelt) and will require surgery while I am pregnant.
Is it worth the time & anxiety to sue the guy who hit me?

Thank you for your inquiry. Without more details, it is difficult to say whether your case warrants a lawsuit. However, from the facts indicated, it appears that you may have a worthwhile claim which should be pursued and investigated. In addition to repair costs and rental car fees, you may also be entitled to the cost of your medical treatment and compensation for your pain and suffering arising from the collision. I know this is a bit late - out with new baby for a week - but to answer your question, you do not always have to file a lawsuit to get results. In fact, it is rare that it is necessary. In this instance, it might be eventually. What you have is a claim against this guy who hit you from behind, and you will need some help to deal with the issues you mention as well as others that you are unaware of.
