Legal Question in Insurance Law in Georgia

Beneficiary was named half sister before our marriage

My husband was killed in a car accident. Noone else was involved in the accident, he lost control of the car and was ejected from the vehicle. He purchased life insurance through his employer in October 2007 and we were married in December 2007. We just had added me to his regular health insurance policy with another company but had not changed his beneficiary information on his life insurance policy. Who would have thought this would have happened? He had always put his half sister down for beneficiary. Now I am having trouble with her because she feels like the money should go to her but I know that he wouldn't have wanted that. He never had time to change the beneficiary to me, his wife. Please let me know if there's anything legally that I can do..please!! Thanks so much for your help.

I do not agree that the situation is hopeless for you. Difficult, yes, but not impossible. If, for example, there is a defect in the beneficiary form sufficient to void the form the law of Georgia states that the money would go to your husband's estate and if he had no will you would get it (same if he had a will and left everything to you). There are other ways out of this situation, too. You need this looked at by an expert insurance attorney ASAP. Do not go to just any lawyer--they won't know what to do. If you contact me I will be happy to give you the name of a really first class attorney who understands insurance matters in your area.I think it is best to get the best local lawyer for this kind of thing rather than someone from outside. Good Luck.

The money is hers -period. There is no way to change that.
