Legal Question in Insurance Law in Georgia
Cancellation of Auto Insurance
I was insured in the state of Georgia. My insurance was canceled May 25,2002.I had an accident June 13,2002 in Beaufort co. South Carolina. The Police Officer in S.C. told me that the insurance should still cover the accident as long as it had not been 30 days since the cancelation date.Is this true or false? The insurance company {Progressive} says they are not liable. Who is right?

Re: Cancellation of Auto Insurance
It's a bit more complicated than is the officer right or not. That might be the law in South Carolina, and I don't know if it is, but in Georgia, if the policy is validly cancelled, then there is no 30 day grace period. Typically in Georgia you get a certified letter in the mail telling you that in 10 days you will be cancelled. If you received such a letter and did nothing to cure the reason you were being cancelled, if you even had the option of curing the problem, such as by paying your premium, then you are out of luck. I would suggest, however, that you actually contact an attorney by phone in your hometown to discuss this. This is not a situation with which I can help you due to a large workload and other considerations. Good luck to you.
