Legal Question in Insurance Law in Georgia
cancellation of health policy
I had major medical incurance. In 2000, I was hospitalized. Last month, I was hospitalized again. The hospital informed me that my insurance was cancelled three years ago. When I asked the insurance company where my checks where ny checks had been going for three years, they said that they had sent the cancellation notice and had been refunding my checks to the address where I lived six years ago. They have never received a check from that address, nor was my name on the checks. They were being sent from my father's autamatic bill pay. If I had known that I didn't have insurance, I would have gone to a different hospital. Do I have any recourse here? I now have $20,000 of debt and no way to pay it. Can I sue the insurance company to get them to pay? How do I get my money back for the three years that I was paying?

Re: cancellation of health policy
Smells like fraud. They would have gotten back the checks they mailed to a bad address and should have know you did not live there. In addition, the payments you were making should have put them on some notice of where you were.
Did they deposit any of the funds?
