Legal Question in Insurance Law in Georgia

My child was seen at a physician's office. My ex-husband is required by court order to carry health insurance coverage on him. I also carry coverage on my son through my employer. The physician's office is telling me that my coverage is primary and dad's is secondary, because of The Birthday Rule. Is this right?
