Insurance Denial-Conflicting Storys
Hi,
I had an auto accident a month back. The police cited the
other driver for negligence and as well as arrested him as
he did not have a driving liscence.
Now the insurance (UAIC) Denies my claim saying that the
other person has a different story and sent me a letter
saying insurance claim denied due to conflicting stories and
says it is 50/50 Loss.
Do they have the right to say this as there are no witness
and the police report clearly shows he is at fault.

The police report is, in general terms, the opinion of the police officer and not "proof." The other party can contest the conclusions and ticket. The insurance company can also review the stories and come to their own conclusions and position.
