Legal Question in Insurance Law in Georgia
I am legally blind based on visual field criteria (optic nerve damage) I have an insurance policy that has a 'total loss of sight' clause. They keep denying my claim because one eye can be corrected to 20/40. Does the poor visual fieldevaluation override the standard definition of loss of sight? Thank you, Faith

Very often an insurance claim of this type turns on the exact language of the policy. I would need to see your medical records and the policy itself in order to give an opinion. Also, whether or not the controlling law is state law or the Federal ERISA statute and supporting Federal case law is very important.
