Legal Question in Insurance Law in Georgia

My mother works for a Living Assistant Home and she had surgery and was out of work for 6 weeks . The Home was bought out by another company and now she has no insurance . She was told that because she wasn't working that her insurance did not roll over. Can this really happen?

I suggest you investigate further. COBRA may be an option for your family, without more specifics its difficult to speculate.

Employers have no obligation to provide insurance unless there is a signed contract. However, they MUST offer COBRA coverage in most cases when insurance is cancelled, so you should check on that.

There is a US statute that protects workers from this very thing called the Family Medical Leave Act. Whether the employer likes it or not your mother is still supposed to be an employee while she is out of work for medical reasons. there are time limits to this, however. Contact an attorney experienced in employment law immediately. Most lawyers do not understand this area of the law so just calling any lawyer will not suffice.
