Personal Injury Liability
As Realtors, we are not employees of the company that we work for, we are independent contractors. An asociate of mine; a fellow Realtor, fell down the stairs at work last week and broke her arm and also has a knot on the top of her spine and is being X-rayed this morning to have her back checked out. She is quite upset, because the company has told her that she has to file all medical claims under her personal insurance, and that they have no responsibilty. There were witnesses to her fall. My question is....... doesn't the business have to carry liabilty insurance for anyone hurt or injured on their property, or does the injured party have to prove negligence in order to have the company's insurance carrier pay for the medical bills?

Most commercial premises policies have a medical payments coverage that pays regardless of fault as a part of the policy. Also, there should be a liability coverage as well so a person injured as a result of negligence of the owner or occupier can make a claim. I should also mention that in the middle of this is at least the question of possible workers compensation coverage. Ron Lowry
