Am I required to repair my vehicle?
My vehicle was involved in an accident with a truck, but it is still safe to drive. The other driver was cited for improper lane change, and his company's insurance company is handling the claim. I had been planning to trade or sell this vehicle prior to the accident. The repair estimate is not enough to ''total'' the vehicle, but it is more than I think that the increase in trade in/sell value would be if I had it fixed. Therefore, I would rather sell it ''as is'' and not repair it. Since his company's insurance will be paying the claim, am I obligated to have the repairs made? There is no lien on the vehicle and it is safe to drive.

You are not required to anything specific, absent a contractual obligation, with the money the insurance company writes to you. The money is given to compensate you for your loss, not to specifically pay for repairs. The repair estimate is simply an objective way to figure the damage.
