Legal Question in Insurance Law in Georgia

theft from vehicle parked in public garage

Our car was burglarized while parked in a public garage.

Our hotel provided us with a self-park enter/exit key--name removed--part of our room price. The garage is operated by a management company, not the hotel.

Thieves took a large suitcase with personal items. The theft was captured on the hotel's video survellience cameras.

The garage management firm says they're not responsible for re-imbursing us for our loss. We haven't spoken to the hotel yet.

Do we have recourse to collect & replace stolen items from either garage management or the hotel?

Re: theft from vehicle parked in public garage

As a general rule, you assume the risk of parking in a garage (odds are both signs and the parking ticket alerted you to that). Your car insurance, if you have full coverage, would usually cover such a loss, and, in some cases, your homeowners insurance may also provide coverage. Bear in mind, if the claim is small, a consequence of a claim is often non-renewal of insurance.
