totalled car w/no collision insurance, accident was not my fault

In an accident my car was badly damaged and as per the auto body shop it is totalled. Unfortunately I have not taken collission insurance. As per the police it was the other driver's fault whose car hit my car.

How do I pursue his insurance for repairs an my injuries.

Is there any way to put claim on my insurance.

The process can get confusing. If you have injuries, the best thing to do is seek immediate medical attention. There are a few steps that should be taken to preserve your claim. Since you mention collision coverage, I would assume you are upside down in your loan. If that is the case, you should check to see if you have gap coverage. The other driver's insurance company should be in touch with you in the very near future. Be very careful what you say to them, as they record those conversations and they will use information against you in the future. There are two parts to every claim, 1. property damage settlement and 2. bodily injury settlement.

I would suggest you hire a lawyer. It is a serious accident if your car is totaled. The more injury sustained, the more you need an attorney. The insurance company already has a team working against you behind closed doors.
