Am I able to sue a company that I'm paying to help put my idea on the market but I start seeing it on the market before I'm finished paying?

You certainly should have a lot of paperwork to set forth the duties and obligations of the parties, and you should have had a lawyer review (or draft) the documents. No one here has them, so of course no one can tell you whether or not you have a claim.
No one here can answer you as no one here has seen your written contract with the company to know its terms. Assuming you were not completely foolish you got a written contract and reviewed it with an IP lawyer before signing. He will know.
As a Franchise Attorney I agree with the other attorney answers and only add the following. Who is the person or party marketing the product? If another person has the same "idea" there's nothing you can do - unless you have a registered patent. Consult with a good business or franchise attorney in your area for specific advice.
