Legal Question in Intellectual Property in Georgia

Use of website URL name

I am starting a company with a url address fakecompanyname(dot)com. The companys legal name is Fake Company Name. There is another company that has a site called fake-company-name(dot)com. However, at the bottom of their page they have a copyright logo with the url address fakecompanyname(dot)com. This address is picking up on google searches and make it appear as if we are connected with their business. Do I have a legal right to ask them to stop using my companies URL address on their web site?

Since they were established first,you will likely be targeted for TM infringement.
