Legal Question in Juvenile Dependency in Georgia

My son pushed Kid X at school who called him names, including Nigger ; Another Kid Y pushed the kid X, then he fail down and broken his arm. Now all kids are charged in court. My son Simple Battery, Kid Y Battery and Kid X disconduct. Kid X has been using bad language for 4 weeks prior to pushing and has said he will a gun. The DA wants to go to court with this.

You can ask for the child to have an attorney appointed for his defense. Schools have a no tolerance policy about fighting in school. If you do not plan to hire an attorney or get the child an appointed one, then try to find out who the solicitor is and explain the situation to him or her. Also explain the fact that kid X said he has a gun and was using the N word at your son. If the child conveyed a threat toward your child about that gun, you should also bring that to the solicitor's attention.
The first hearing will be an arraignment where your son can plead guilty or not guilty and ask for an attorney. In many cases if you cannot hire one for him, he can get a public defender. If you talk to the solicitor beforehand, they may be recommending a diversion for him, such as a class for the child about Georgia law or probation, or both. Most judges will also order the children who were fighting to stay away from each other.
