Legal Question in Employment Law in Georgia

Is this age discrimination?

I am 57 years old - I made a mistake at work (not even a huge one) my boss screamed at me repeatedly ''even a 22 year old could do this''. I was subsequently fired and even during the firing he said a 22 year old could do this...

It's tough enough being this age and out of a job without someone throwing it in your face.

Re: Is this age discrimination?

It might have been a demeaning comment, but it appears to be demeaning toward your work and not your aqe. From the few facts, it also appears you were fired because of what they thought of your work, and not your age.

Re: Is this age discrimination?

The Age Discrimination in Employment Act (ADEA) prohibits discrimination based on age and protects employees who are 40 years and older. The ADEA also prohibits retaliation against an employee who complains of age discrimination. You may very well have a solid case, depending on how may employees your former employer has and whether the reason for your firing was merely a pretext to get rid of a 57 year old employee.

If you wish to pursue this, contact me and we can discuss in greater depth your options and chances of success. But whether you choose to go with my law firm or not, if you wish to pursue a claim, be aware that age discrimination claims are time sensitive and you should not wait before consulting an attorney.
