Attorneys Fees

Who pays the fees for the attorney filing on behalf of the wronged employee? Obviously, if the petitioner hasn't been paid, they cannot afford to lose more money to attorney's fees.

Ask the lawyer handling the case. There is no way for anyone here to know what the agreement is.

The person who engages the services of lawyer has to pay the fee.

Many of the fair employment statutes, including the anti-discrimination laws, provide that a "prevailing plaintiff" is entitled to recover his/her attorneys' fees from the defendant-employer. However, this assumes that your case is actually litigated to a final judgment. The vast majority of cases settle before that happens. In settlement negotiations, we would attempt to recover attorneys' fees along with a payment to you.
