Legal Question in Employment Law in Georgia
Child with Cancer
I work for the State of Georgia. On May 04, 2005 my daughter was diagnosed with Leukemia. She underwent a bone marrow transplant. I was out of work approximately 8 months graciously ''paid'' by other employee donations of time. I have returned to work and was placed in a new position 25 miles further from home. I know there will be times that I will be out with my daughter, but I am feeling a ''little uncomfortable'', or should I say ''unstable'' at my position now. I feel as they are looking for me to resign. If further leave is needed with my daughter, can they find a reason to fire me? I am the insurance provider for my child and it really scares me to think I could be without insurance on her. Thanks.

Re: Child with Cancer
The reality is that employer, including the government, is not requred to maintain the employment of someone who misses several months at a time. They really do not need to "find" another reason. I am assuming you have no contract or other agreement and you are an "at will" employee. Check any paperwork or handbook on the subject. You certainly will choose your daughters well-being, but they are entitled to an employee who is able to do the work. You should certainly be eligible for COBRA or other continuation of insurance benefits, but you will want to discretely check all of your insurance benefits. Good luck.
