Legal Question in Employment Law in Georgia
a company sales rep, paid salary and commission, makes a sale and is paid the commission for the sale. the customer does not pay for the order on time and goes past due. The company then deducts the commission paid back from the rep. Before the account is placed with a collection agency the sales rep helps collect the payment for the company for the order. the company has now received the payment in full. is the company legally obligated to pay the rep back for the deducted commission since it received the payment for the order , even if the payment was late??
