Legal Question in Employment Law in Georgia
Company goes against written policy
I was a manager for a company and was going to let this issue go, but, since they challeneged my unemployment I am considering pursuing it. As a manager I had an employee who did not use all of his vacation. The company has a written policy that states if you do not use it, you lose it and will not be paid for it. My employee dwas going to lose his and I told him it was policy. He went over my head to the director and HR and they paid him undeer an ''incentive'' payment in order to keep him happy. I was told to keep quiet even though I had 7 days I lost due to not being able to take my vacation. When I asked to be paid for mine I was told no. Can I go back now through legal means or to the Department of Labor and file a grievance? If they are going to waste my time with these hearings to challenge y unemployment when they have lost every time, I think I should do something to cause them to cease and desist. They violate written policies regularly and this one has an adverse affect on me personally.

Re: Company goes against written policy
You do not say how the company going against their policies harmed you (or anyone else except themselves, for that matter) or affected you in any meaningful way. Employers provide benefits and incentives for employees they want to keep or make happy. That does not mean everyone else should get the same extra benefit (unless there is a contract providing for this). The notion they should "cease and desist" providing extra benefits to valuable employees is not likely a reasonable position. Taking these positions in the meetings with the Dept of Labor might very well sound like sour grapes and overshadow any valid arguments you might have.
