Legal Question in Employment Law in Georgia

Demotion...

I realize Georgia is an at-will state and I have now been offered a demotion that I may have to take. My complaint: There were 2 positions open that were equal to or greater than the position I currently hold. My company has a job posting program, but failed to post either of these positions. After learning of them, I requested an interview for each. An interview was promised but never given and both positions were filled with other candidates - with less tenure/experience than I have. Do I have any legal say in this?

Re: Demotion...

I hate to say this to you, but probably not. If you are in a union, and the company violated the collective bargaining agreement, you may be able to file a grievance. Otherwise, unless you feel that the reason why you didn't get the interviews/positions was because of some illegal discrimination, you probably do not have much of a legal argument. Companies are allowed to be as unfair as they want, as long as they do not make decisions for illegal reasons.

The foregoing is general information only, not specific legal advice. No attorney/client relationship has been created or should be implied. Consult with an attorney of your choosing before taking legal action.
