Legal Question in Employment Law in Georgia

Draw repayment

I took a draw when I started a job as an independant rep in Feb. of 2007. In Nov. 2007 I was offered a company rep position and asked the remainder of the draw be forgiven as part of the package. My boss at the time said yes it would go away. That was it. Now a year later my company is telling me the remainder of the draw is still due. I have not had any deductions since I took the company position, now a year later they are telling me I still owe this money. What are my options?

Re: Draw repayment

You can refuse to return the money and run the risk that you will be terminated and/or be the subject of a law suit, to which you may have a good defense if they verbally contracted to forgive the draw. On the other end, you can pay it and just move one. Or you can take action some where in between. I would suggest trying to work it out with them and maybe have an attorney send a demand letter depending on how much is owed.
