Legal Question in Employment Law in Georgia

Emloyment Compete Contact

I signed a contract with my ex employer and feel I have grounds to sue him. The contract I signed has a specific ''venue selection'' sentence in the contract. All the work I did was in Georgia but the ''venue'' is out of state. Does that mean I have to sue him in the state where the contract says?

Such forum selection clauses have been generally upheld in Georgia. However, if the venue selected is simply for the convenience of the employer, you have a better chance of having it declared invalid. So, if you sue here in Georgia, the employer will probably try and gave it dismissed and might bring the action in the selected state. Have a local attorney review the contract and give you a more comprehensive opinion.

Generally, yes, that is what the provision means and, again generally, they are valid. Whether the specific provision in your contract would require you to file in the other venue cannot be answered. We don't know the grounds for your lawsuit, or how it relates to the contract. The lawyer you retain to review and possibly file the suit (who should practice in whatever area it is) will answer the question.
