Legal Question in Employment Law in Georgia
Just asking
I am a new employee for a company (which means that I am on probation). I work inside a vault area which is not cleaned by the cleaning crew since there is a large sum of money in that area. The first night I worked in the area, I began to feel sick from the dust. I was developing a slight soarness in my throat and a was coughing. That night, I went to the hospital because I was having an allergic reaction from the dust which caused my throat to close. When I advised my supervisor that my doctor advised me not to work in that environment and to find another area for me to work, he stated that it will be a problem. My question is can I get fired for not being able to work in an unhealthy environment, since I am on probation?

Unless you have a contract, employment is "at will," meaning you can be terminated for any reason or no reason (with rare exceptions apparently not applicable here). Conversely, the employee also has a right to quit at any time. Also, the fact that you have an allergy does not necessarily mean it is an "unhealthy environment," and your allergy is unlikely to qualify as a "disability." Taking a job that turns out to not be a good fit does not generally entitle one to guaranteed employment.
