my employee pays me when he feels like it

I work for a very small company and am paid salary. Often when I receive checks they bounce and more often than that is a promise I will get one next week and that never happens.Currently I am owed $ 10,000. Even though I am paid salary could I still sue in small claims? Also, there are numerous fellow co-workers who are owed a lot more than myself who have resided themselves to never seeing a penny.Legally could we all get together and sue as a group?

If you are owed $10,000, you can sue in Magistrate Court. The Magistrate Court has jurisdiction over claims up to $15,000. However, if your co-workers want to join in a class action, that could not proceed in magistrate court. If, however, each employee is owed less than $15,000, they could each individually file in that court.
