Legal Question in Employment Law in Georgia
Can an employeer make the location of your residence a condition of employment?
I live in a city about 130 miles from my employer and commute daily. Recently, my employer has asked me to relocate my personal residence as a ''condition of employment''. I have been in the job and communting for over a year with no attenence/performance issues related to my residence location. I have asked for no special treatment for my choice of residence (ie: milage reimbursement, hotel expenses, flex time, etc.). Is the request for relocation of my residence legal?

What you probably need to do is to determine why your employer is making this a condition of employment. For example, does your employer need you to be available to work unscheduled times with little notice? Does the employer want to expand your working hours? These and other questions might answer why the employer wants you to be closer. I am not aware of anything prohibiting your employer from making such a requirement, but unless there are specific reasons why the employer needs you to be closer, it may not be good business practices. The only way that I could see that the employer could not make this requirement legally is if there is some discriminatory reason for the requirement.
