Legal Question in Employment Law in Georgia
Employer cancelled paycheck
I quit my job, my employer handed me my final paycheck at my home, I deposited it in my bank account, several days later I recieved notice from my bank that the check was cancelled by my employer along with a copy of the cancelled check.
I called my employer about this situation and he told me since he had to come and pick up his van at my home he was going to charge me for his time deducting money from my pay check and would let me know how much and when he would be sending me a new adjusted check.
I told him dont bother I'll be seeking legal advice I also informed him since I quit my job I was no longer an employee and not covered by his auto insurance and would be illegal for me to drive his van to his shop to be dropped off. What can I do to recover my full pay and bank charges for cancelled check, bounce fees and running around time trying to fix my account problems do to his action also pain and suffering (mental stress and worrie). I live in a different city and county than his office, about 35 miles away.

Re: Employer cancelled paycheck
The easiest course of action is to file a suit in Small Claims/Magistrate Court for your actual damages (wages, bank fees). The forms are generally self-explanatory. You may also contact the local Dept. of Labor, who may exert some pressure on the employer. Pain & suffering damages are not intended for worrying about a financial matter.
