Legal Question in Employment Law in Georgia
My employer pays monthly; it is clearly stated that payday is the 15th of every month. On several occasions I have not been paid on time, receiving my paycheck on the 16th or 17th of the month. Yesterday I was informed that our payday is being changed to the 25th of every month. This comes as a huge shock and means that I am going to go past the one month mark before being paid again. Also, we are reimbursed for mileage and that check has yet to be received. It is also due on the 15th of the month. Today is the 27th and yet I have not received that check that was due on the 15th. I have been told that when my employer receives the money from the state I will get my check. (MY employer has a contract to provide services for the GA DFCS) This seems shady to me and I am wondering what my legal standing is as far as the paydate being changed and not receiving my mileage reimbursement in a timely manner.

When you say "legal standing," first ask yourself what that means. That usually means standing to file a lawsuit, or threaten a lawsuit. Unless you are prepared to do that, or even threaten a lawsuit, it may be wise to think about it. You probably wont sue over one paycheck or mileage and when you make the threat, it will likely be your last paycheck. The best thing you can do is start looking for another job. Your story does not necessarily look shady - it looks like the company is in financial trouble and is unable to pay employees until checks come in. That is a bad sign for the company and employees. Checks a few days late is better than no check at all, so you'll have to decide how far to press it as you are looking for another job.
