Employment Contract

Hi

My employment contract says that I can not be employed or indirectly work for any of the company's clients I worked while employed. And that this will hold for 12 months after I have resigned from the company.

Does this holds valid under Georgia Labour Law?

A one year restriction may be enforceable in a number of situations. We can't speculate about whether it is reasonable and enforceable in your specific situation, which is the real test.

There are three factors courts consider in determining if a non-compete is enforceable in Georgia - time, scope and geography. One year is generally acceptable and the scope may or may not be acceptable depending on the facts surrounding your employment. You didn’t mention any geographical limitations. You should have a local business or labor/employment attorney review the entire contract. There may be other provisions that affect your rights.
