Legal Question in Employment Law in Georgia

False references.

Hi, I have been out of work for nine months, partly due to an untrue reference given by a former employer. They are telling perspestive employers that I have only worked for them two months. I worked for them a little over two years. This makes it look like I am lying on my application which is grounds for not hiring or termination if hired. I know this, because a perspective employer told me this is why my application was being passed over eventhough I was highly qualified for the position. What is my recource. Thanks in advance.

Re: False references.

Former employers are allowed to give true information about former employees. If your former company is lying about the length of your employment, they may be committing defamation. In addition, there is POSSIBLY a claim of tortious interference with prospective contractual relationsh. Have you talked with your former employer about the problem? There is a possibility that their human resources department simply has the wrong dates for your employment. If you cannot get satisfaction from the former employer, you may want to consult an attorney to see if you have a claim.
