Legal Question in Employment Law in Georgia
My fiance's employer laid him off last week and didnt give him his paycheck. Well he went this Thursday to pick up both of his last checks and they only gave him a certain amount of it. They then tell him they laid him off because they think him and another guy stole a piece of equipment. The day that the equipment was stolen he left early to come home to me because a friend of mine passed away. They said that he stole it then. Anyways they said they took money out of his paycheck to pay for the equipment. They told him if he didnt leave they would call the police and press charges. Can they do this? They dont have any evidence that he did it. All they have is another guy saying he saw him walking to his truck with something in his hands.

If he was an employee (as opposed to a contractor) the Georgia Dept. of Labor, unemployment office, can often assist in these matters.
