Legal Question in Employment Law in Georgia

Labor in the workplace

I am 63 years old and am pushed in my job at work. Anything I do has been done better by someone else back down the line in years to pass. When I asked if this person could have been older than me-- then they said that would be age discrimination.

My Question, Did I not read somewhere that if you are older and have been with the same company for (me 26 yrs.) that they have to give you a lighter job,and they can`t fire you or put you on another shift or cut your pay? Please answer Thank you

Re: Labor in the workplace

Age discrimination is discrimination based upon age. What you describe appears to be performance issues. An employer is not required to continue the employment of someone who is simply not doing a good job, and the employer is not required to maintain a salary for a person who is unable to do the job associated with that salary. They do not have to create a job for someone who cannot perform their current tasks. The ADEA or similar state laws do not provide for job security for people who simply cannot perform the work.
