misleading background check
A background check was done on me and it was done with my name and partial birthdate.
It kept me from being hired at Home Depot.
The firm admitted making an error and asked how they could rectify the situation.
I was going to ask for a monetary cash award. Would I have justification to do this?
I have missed out on 4 weeks of work and I have the embarrasement of telling my company I was a convicted felon. I have documented all of my phone calls and all of there tiring non answers. The gentleman I spoke to was quite appologetic and admitted an error had occurred and the report should never have gone out.

You don't actually say what was "misleading" or in error, so we can't speculate You mention the report kept you from being hired, then you mention telling your company you were an admitted felon (implying you were employed). There being no way to piece together this story, I'll simply say that if they are offering to do something, and you want to ask for money, go ahead.
