Legal Question in Employment Law in Georgia

My niece is in her first year of college. Over the summer she worked as a server at Waffle House. I just discovered that they have been paying her in cash. Most days she worked 12 -16 hour shifts. Is this legeal? If not, what can I do to rectify the situation?

The problem with getting paid under the table is that state and federal taxes are probably not being taken out of the pay. Does she receive a pay stub? She can contact Waffle House's HR department to clarify her status.

It may be that HR doesn't know about this pay situation. However, keep in mind, the result of complaining about the situation may be termination.
